  1. should we send all documents to CHC VO after receiveing this PER or wait for AOR from VO

    • This process is for post-June-26 2010, and as such all documents are sent with your initial application to CIO in Sydney, Canada. There is no requirement to send anything to the visa office unless you are asked by them.

      If you did not submit your PCC with the initial application (since they are optional) you will need to send them when visa office ask, probably when they ask for medicals.

    I got an email last January 2011 stating the same format as above… your application received a positive final determination, i was wondering why the local visa office sent us a letter last February 2011 that I am not eligible for processing for the reason that they are not satisfied that i had a minimum of one year continuous full time or equivalent part time paid work experience in the occupation in the last 10 years…am wondering bec i been working for the past 17 years and 7 years under the same job and paid full time…can the visa office contradict the CIO? This is a grave mistake!

  4. Hi, I was hoping you may be able to give me some advice as to how long we should expect to wait to hear from CIC. Our application arrived in Sydney on 28th February 2011 and our credit card was charged a few days later.

    After reading a few forum posts I have been expecting a 4 month wait (end of June) for PER but recent posts show other applicants that applied later than us have already got their PERs but we have still not heard anything at all. Should we be worried? I am reassured that it is with them as the card was charged but can’t understand why later applications would have their PERs before ours?

    Any advice would be greatly appreciated!

    • Hi Lisa,

      I would definitely contact CIO now if I were you. It is true that the early applicants post-June-2010 had to wait 4 months or more for PER, but most applicants now are only waiting around one month to hear.

      If your card was charged, this means the application is with them and it passed the completeness check, which is the first stage at CIO where they check you have included all forms, all supporting documents, all fields have been entered and forms signed, correct payment etc. But next is the full eligibility review which CIO do prior to mailing your application to the visa office. So if you haven’t heard by now it is possible that the communication may have gone adrift – perhaps they entered your email address wrong, or the confirmation email they sent you ended up in your junk folder?

      Anyway if you email FSW-Sydney-Search-Enquiry@cic.gc.ca with your full name, address, date of birth, NOC code and as much detail as you can give – they should be able to tell you the status of your application.

      • Thanks Wayne, I used the online contact form on the CIC website yesterday afternoon but I guess this goes to the same place as the email you posted?

        There is nothing in the Junk folder.

        I am not too concerned as no refund on credit card, my only worry is that they have the email address down wrong so we won’t get anything else they send! When the London office gets in touch do they use email or post?

    I applied for FSW1 and my current status in ECAS shows “Centralized Intake Office Sydney (CIO-S) Eligibility Review Complete” . when I click the status link I see

    “We received your application for permanent residence on February xx, 2011.

    We reviewed your application and sent you a letter on March xx, 2011. Please consider delays in mail delivery before contacting us.”

    Can you please tell me what is the time frame to see “PER” status. Thanks

    • The line “We reviewed your application and sent you a letter on March xx, 2011” is when they would have sent your PER or NER (positive or negative eligibility review). Did you receive an email from them?

      If not, send CIO a query (you can get the email address from my contacts page here on the blog) – they will be able to tell you when they sent the decision and what the outcome was.

  6. Hi,

    I had submitted my application in late 2009 and got a similar PER letter from sydney on 3rd March 2010 and they had asked me to send documents to CIC-London, they have accepted my payment as per the said letter. I then got another 2nd AOR from London in Aug 2010 and online stauts is “Received by visa office”.

    Please advice what should i do as it is more than 1 years since i recived my 2nd AOR.

    • Hi. You can try contacting the visa office but I am fairly sure all they will says is “your file is still awaiting review”. Pre-June-2010 are on a lower priority than post-June-2010 and some visa offices have said it could be 2 further years or more before some of these can be processed.

      Unfortunately all you can really do is wait at the moment. Since there is a very real chance it could take 2 years (2013)+ for your case to be processed, have you considered trying to secure a job offer and re-applyin under FSW2 in order to get there more quickly?

    when I received this letter..I want to appeal and comply all necessary documents to satisfy the CIO officer..
    I always checked my e-cas and it still in a : CIO-S eligibility criteria complete.

    Question: Can I appeal this letter from CIO..?

    • Ok, let’s try to get a few things straight.

      1) You have applied, under which category? I am assuming under Federal Skilled Worker, Category 2?

      2) Seems like they rejected your application because your work is not highly skilled enough. In order to apply your work must be in skill types 0, A or B. So even if you have an LMO if it is in skill types C, D or E then you will not be eligible to apply for permanent residency.

      3) What is your connection to this Mercan Ltd? Are these immigration lawyers which you have hired?

      Anyway, from what I have seen there is nothing you can do to be eligible for Federal Skilled Worker UNLESS you can secure more highly skilled work.

  8. I have spoke with my employer about this and the only thing that he would say is He will help in some way..
    So what he did is let me spoke one of the lawyer of mercan..and the lawyer did told me that, when they review my papers I am not qualify either of the category for permanent in canada,..so I let them show the email that was sent to me by FSW or CIO officer and all they said is you have to be a manager..
    I don’t really think that my employer will hire me as manager right now..because they still have lots of managers in the store that are citizens in canada..with the lots of paper works to do.

    It’s been 8 months now since the confirmation of CIO that I am not qualified..I just wander sometimes what if I will change my job or noc code. to cook or baker or look for some employer who is willing to change my LMO to skilled.
    Or look for someone to help me have an AEO..
    I don’t really know what to do..I never went to any lawyer to do my papers..
    It’s just so happen that my employer is under mercan..and I don’t want to pay thousand dollars just to appeal or if they will help me with papers to change in skilled.
    I have spoke with my employer yesterday and the only thing he could do is to renew me and thats it.

    I don’t have any resources for now..The only thing I have in mind is to write a letter to the CIO officer telling things of what I did when I received the confirmation letter via email..

    also phoned mercan ltd. in saskatoon if they have received my papers on file,they said ..they did not received any.
    just want to know if the CIO will returned all my documents to Mercan ltd.wherein I did ask help from any Mercan employee to do my papers..

    right now , I have lose my hopes..I guess canada is not for me..I will just wait for the 4yrs.( 2015) for all temporary worker to be going home and look for any other country to work again..

  10. positive final determination of eligibility – WHAT DOES THIS MEAN. BEFOR MY SECOND AOR I RECEIVED A LETTER FROM CIO STATING THIS.

    • Hi congratulations. This means that your application has been found eligible and will now be sent to the visa office for background document checks/security checks etc.

      Next communication you will get should be 2nd AOR, and medical requests after that.

  11. We have received our eligibility positive email on 3rd november, what would be the next steps. Are there any chances of the application now getting rejected?. How much more time would it take to get our request processed and to get the Visa? Where would our file be sent now

    • PLEASE stop posting the same message twice. I will respond as soon as I can but it can take several days to get through all the posts (I logged on today and had over 30 posts).

      Next stage is that your case will be forward to your visa office, please look at my “Process” page for a detailed view of how it will go.

      There are so many factors that it is impossible to predict when you will get your visa. Could be as fast as 3 months from when your application gets to the visa office. Some post-June-2010 applicants have been waiting for almost 1.5 years and no visa yet.

    I have recieved my PER on the 16th of November 2011. The ECAS is now showing In Process and the address. when i click on ‘In Process’ it tells me that my application was recieved on the 24th of August 2011.
    is this how it happens?
    Secondly, what are the things which can go wrong at VO stage. Like if the are not convinced by some information will they ask for clarification or do the reject the application altogether.

    I applied on 8th August 2011. I also got the file number few week before. But till date didn’t get PER or NER. So I send mail to CIO few days before. Today I got message from him “Your file is still pending final review and decision by our office. You will be contacted in due course.” So what does it means. Is there PER is completed or not?

    • Alas the length of time it takes for people to go in process does vary from visa office to visa office, and from applicant to applicant.

      Since you got PER only 4 months ago I would be patient and just wait, some people have had to wait a lot longer than you! 🙂

  15. Today I got email from CIO with rejection. Pls. guide me on this.

    “I have now completed the assessment of your application for a permanent resident visa as a skilled worker. I have determined that you do not meet the requirements for immigration to Canada.

    Subsection 12(2) of the Immigration and Refugee Protection Act (IRPA) states that a foreign national may be selected as a member of the economic class on the basis of their ability to become economically established in Canada. Subsection 75(1) of the regulations prescribes the Federal Skilled Worker class as a class of persons who are skilled workers and who may become permanent residents on the basis of their ability to become economically established in Canada.

    Pursuant to the Immigration and Refugee Protection Regulations, 2002, skilled worker applicants are assessed on the basis of the requirements set out in subsection 75(2) and the criteria set out in subsection 76(1). The assessment of these requirements determines whether a skilled worker will be able to become economically established in Canada. The criteria are age, education, knowledge of Canada’s official languages, experience, arranged employment and adaptability.

    • I am unsure what you expect me to say? Your application failed because you do not have 67 points. They will not consider any new information.

      Since you were only 3 points short, you may be able to re-apply, perhaps if you can secure better language test results, if your NOC is still on the list.

    I applied to CIC/CIO in February 2012 as a FSW using a UCI i received when I applied for a Temporary Visa. I have not received as official response, however I used the UCI # to check and on the 1st page it says “Permanent Residence Application Status In Process”, If you want to see the details of an application, click on the underlined status. In Process is underlined so I clicked it and this is the result “We received your application for permanent residence on February xxx, 2012. ” When I check what IN PROCESS means I see that there are five (5) other steps prior to that.

    My question is, how do I get to “In Process” without getting an e-mail or letter, so is it that I have passed through all the other five (5) stages; APPLICATION RECEIVED—>ELIGIBILITY REVIEW COMPLETE–>RECEIVED BY VISA OFFICE–>VISA OFFICE ELIGIBILITY REVIEW COMPLETE–>WITHDRAWN–>IN PROCESS

    Please tell me what is happening here, because I want to know if by happiness is baseless. I applied as a Chef/Cook.

    I want to know that i submitted my application FSW to CIC office after 2 months i got my all documents back because i submitted academic IELTS test they mentioned it that according to my case general ielts Require so i done My General test and sent back my all documents once again i also got UCI number .My Question is i got 75 Points from cic ..and now how much time will take for processing .Please Guide me i really need your help.

    I am applicant under FSW my application received by CIC on 2/sep/2011 . I received the PER on December 1st 2011 which mentioned that (Your application will be forwarded to a visa office for further processing . I sent the update of my new baby born on 5/December/2011 to London VO . till date(almost 8 months past) I didn’t received any mail from London VO, my E-case shown in process since that time (Based on review of your complete application package, it has been determined that your application is eligible for processing .Processing has begun).

    Please advice if I should emailed the VO asking for my statues or I should be more patient .

    I am an applicant from Pakistan. I applied twice, once when the previous policy was inforce, my application was filed in february 2007. Then i re-applied under FSW in December 2011.

    In response to my FSW application, i received an email from CIC on 20th Feb 2012, informing me that my application has recieved positive eligibility review from cic and the application is being forwarded to London office, with the instruction that i should inform about any update / change in my address, email, family, etc. directly to London office, which i did, since i was blessed with a baby boy in Decmber 2011, so i sent copy of his passport, birth certificate, fee, photographs to London office.

    Now when i see my e-case status on cic web site. When i put my id (UCI number), i find status of both of my applications as “In-process”, when i click my new application i get following line.

    “We received your application for permanent residence on December 16, 2011. ”

    And when i click my previous applications status which is also “In-process”, i find following lines

    ” We started processing your application on March 30, 2007.

    We transferred your application to the London England office on January 14, 2011. The London England office may contact you.”

    Now, i m confused, as to what is meant here by both applications “In-process” but showing different lines, what is going on? please explain.

    I got my PER, positive final determination of eligibility, email from the Sydney NS office on March 26th 2012. The status of the CIC online enquiry for my file number reads “In Process – we have received your application on March 8, 2012”. My lawyer says that they likely have sent our file to Buffalo for further processing but I didn’t see any updates on this online. (It’s now August – 4 months have passed) Should I be worried, and should I be contacting the 1-800 number on CIC website? My husband and I both have arranged employment and working in Alberta now. Our work permit expires in end-October 2013. I hope to get the PR way before the expiry.

    Plz also give me your precious help…i have first applied in June 2011 under FSW electrical trade for tronto but did not receive any confirmation or temporary file number…after inquiry we came to know that bar code papers are changed and then we again did correct bar code papers along with fresh PCC and funds in Feb 2012…but now it is July 2013 and i am still without any confirmation that my case is going on or not…no temporary or permanent file number received..

    Plz give suggestions what to do…Is this happens..

I have not received as official response, however I used the UCI # to check and on the 1st page it says “Permanent Residence Application Status In Process”, If you want to see the details of an application, click on the underlined status. In Process is underlined so I clicked it and this is the result “We received your application for permanent residence on October xxx, 2013. ” When I check what IN PROCESS means I see that there are five (5) other steps prior to that.

    My question is, how do I get to “In Process” without getting an e-mail or letter, so is it that I have passed through all the other five (5) stages; APPLICATION RECEIVED—>ELIGIBILITY REVIEW COMPLETE–>RECEIVED BY VISA OFFICE–>VISA OFFICE ELIGIBILITY REVIEW COMPLETE–>WITHDRAWN–>IN PROCESS

    Please tell me what is happening here, because I want to know if by happiness is baseless. I applied as a Baker.

    I applied under FSWP 2013 .Feb 15th 2014 i got my Request letter for medicals, RPRF,PCC and Papports from New Delhi !! My medical results have been emailed to CHC New Delhi by hospital on 22nd March 2014 and we have submitted our RPRF,PCC and passports !! But still my ECAS shows “IN PROCESS” !! Now within how many days/months it may change to “Medicals received” and within how many months can i know the result ?
